Please be patient, you emails are being answered, I see the pile deminish each day, so I am on it.
I recently lost a mate I served with in the military, now I find my music mate of 20 years has a suspected cancer.
So for 10 days I have been away from the news desk to be with him and at the same time being entertained by that Punch and Judy show, "Our Politicians Polling Booth Pantomime" funded by all of us, with result, as always, one of just two options.
Resuming my seat upon the "Titanic Australia", hosting few serviceable lifeboats, all pre- assigned to the political masters, I shudder at our future once AGAIN.
We now wade further to the shallow end of the gene pool, joining our new political masters, when depth is required to claim back our nation.
To all independent who fought, well done, to Liberal's, your true colours were hoisted on your Titanic, to Kevin Rudd, you will now require divine intervention.
to you my fellow people, lets us take no prisoners and start exposing the pandora boxes. We have seen Ruth Downey, a 70 year old farmer, have the RSPC invade her property to execute her cattle, leaving their calves to starvation.
We have seen a family raided by in NSW by Phil Koperberg, Environment Minister, and Malcolm Turnbull, then Federal Environment Minister, heading a military assault, subjecting this family to hours of interrogation, in their home, not to mention the massive legal violations they sanctioned as Reich Marshal's
commanding a convoy of brown shirts mounted in government vehicles.
It is time to shut the gate on this Nazi Germany revisited dictatorship.
During 1990 into 1991, in South Australia, a man stood up for his rights, loosing the case, took his grievance to the High Court of Australia, where it was found police trespassing, under government sanction, had illegally entered property, they did not understand the law that protects you today.
Quotation from the High Court transcript:
"The poorest man may in his cottage bid defiance to all the forces of the Crown. It may be frail - its roof may shake - the wind may blow through it - the storm may enter - the rain may enter - but the King of England cannot enter - all his force dares not cross the threshold of the ruined tenement.' So be it - unless he has justification by law."
Further information from that transcript:
Constable Dillon, accompanied by Constable Will, went to Mr Plenty's farm, South Australia in 1978, in order to serve the fresh summons either personally on the child or, by non-personal service, on the father.
Their entry onto the farm for this purpose was the occasion of an alleged trespass for which Mr Plenty brought the present action.
He joined as defendants Constables Dillon and Will, their senior officer and the State of South Australia. It is unnecessary to trace the full history of the matter except to say that, in the view taken of the facts by a majority of the Full Court of the Supreme Court of South Australia, Mr Plenty had expressly revoked any implied consent given to any police constable to enter upon his farm in order to serve the summons or any other document relating to the matter concerning his child.
The appeal to the Full Court proceeded on that footing and the defendants were content to argue the present appeal on the same footing.
Thus the issue for determination is simply whether a police officer who is charged with the duty of serving a summons is authorized, without the consent of the person in possession or entitled to possession of land and without any implied leave or licence, to go upon the land in order to serve the summons.
This is an excerpt from a High Court Hearing that upheld the plaintive Mr Plenty that the police did violate trespass law.
There are just two reasons for authority to enter your property without your permission under law, which is as follows:
"It is laid down as a general rule in our books, that the sheriff, in executing any judicial writ, cannot break open the door of a dwelling-house;(note~ entry onto land in terms it relates to breaking into a dwelling-house) this privilege, which the law allows to a man's habitation, arises from the great regard the law has to every man's safety and quiet, and therefore protects them from the inconveniences which must necessarily attend an unlimited power in the sheriff and his officers in this respect; hence, every man's house is called his castle. 5 Co 91: 3 Inst 162: Moor, 668: Yelv.28: Cro Eliz 908: Dalt Shar 350.
Yet in favour of executions, which are the life of the law, and especially in cases of great necessity, or where the safety of the king and commonwealth are concerned, this general case has the following exceptions, one we have listed:
"That whenever the process is at the suit of the king, the sheriff or his officer may, after request to have the door opened, and refusal, break and enter the house to do execution, either on the party's goods, or take his body, as the case shall be".
So the question is whether the police officers were engaged in "execution of the (King)'s process - clearly they were not.
The decision of the highest court in our land Judges was (the first part only here):
Set aside the order of the Full Court of the Supreme Court of South Australia so far as it dismisses the appeal against the dismissal of the plaintiff's claim in trespass to land. In lieu thereof order that the appeal to that Court be allowed in part and that the judgment of Mohr J. dismissing the plaintiff's claim in trespass to land be set aside and in lieu thereof judgment for damages to be assessed be entered for the plaintiff against the first and second defendants (police officers Dillon and Wills) and such other defendants as the Supreme Court may hold to be liable in trespass to land.

December 12th - 22nd Airline departures interrupted with lighting 24 safety issue strikes
December 15th - 23rd Brewery shutdown over working conditions
December 17th - 26th Rail and bus services on go slow and driver issues
December 22nd - 29th Airline national strike over a yet to be proclaimed issue
January - Month long training of union staff not around when 70's - 80's strike tactics were set in place so they can learn the ropes
The urgency is that NSW National Parks and Wildlife Service, in their typical fashion, have organised some "information sessions" (note not public meetings, not open forums with the opportunity to debate the issue) at very short notice to the public, obviously so no one will turn up. Just look at the days and the timing.

Last week National Parks and Wildlife Service (NPWS) placed their Horse Management Plan Draft (HMP) for Kosciuszko National Park (KNP) on public exhibition.
Our review confirms that this plan is extremely biased in its presentation and we highlight that it fails to mention-
The cultural heritage value of the Snowy Brumby
The Brumbies legendary and iconic status in the eyes of the Australian public
That these Brumbies are the descendants of a large contingent of horses that were shipped overseas and faithfully served our troops in the Sudan Campaign, Boer War, Great War and second World War and were never allowed to return
The Brumbies tourism value and subsequent contribution to the economy
The positive benefits of the Brumby grazing native grasses, the resultant fuel load reduction and sweeter grass for all wildlife
Other critical deficiencies exposed in the plan are-
Failure to provide analysis of and weighting to the major threats to the environment within the park. We contend that any alleged horse impact would not be of a serious or irreversible detrimental nature. At worst any impact would be temporary and short term and would pale into insignificance when compared to the long term impacts of bushfires, predator feral animals, weeds, roads, dams, powerlines, ski resort development and natural occurrences such as snow, ice, rain, flood, wind, earthquakes/ tremors etc.
Failure to provide the actual number of Brumbies to be culled
Lack of any analysis as to what would be the conservative maximum number of Brumbies the park could sustain
Likewise the minimum number required to remain genetically viable and to cover contingencies such as the 2003 bushfires which destroyed 50% of the Brumby population in the southern end of the park
Failure to provide a cost/benefit analysis or details as to whether or not the money could be more effectively spent elsewhere to protect the park
A number of the photographs provided in the plan to suggest Brumby impact are highly suspect and we are seeking more information from NPWS
Fails to provide a mechanism to facilitate full and proper public debate
For NPWS to suggest that our brumby be treated in the same manner as any other vertebrate pest program (eg wild dogs, pigs, foxes, cats etc) is beyond comprehension. It certainly shows the mind set within NPWS and their lack of "feeling" for the protection of our heritage.
NPWS fails to understand that our heritage belongs to all Australians and that the people have not given them a mandate to destroy it.
On this issue we appeal to NPWS to stop, step back and listen to the people.

A Message To RUDD
In order to earn my wages, as I work on a mine site on a Kalgoorlie (WA) construction project, I am required to pass a random urine test, with which I have no problem.
I work, they pay me. I pay my taxes and the government distributes my taxes as it sees fit.
What I do have a problem with is the distribution of my taxes to people who don't have to pass a urine test.
Never would I, but should I fail that urine test I loose my job and there are no wages or taxes anymore.
I would therefore suggest that unemployed recipients of Centerlink Payment be required also to pass a urine test to collect benefits as I am required to pass one to earn that money for them.
Please understand - I have no problem with helping people get back on their feet. I do on the other hand have a great problem with helping someone sit on their backsides drinking grog & smoking dope.
Could you imagine how much money the Government would save if people had to pass a urine test to get the dole?
Something has to change in this country, and soon!

A GREENS MP has launched an extraordinary defence of spray can vandals, saying graffiti brightened up the city and could be attractive.
Sue Pennicuik told State Parliament new laws cracking down on graffiti vandals were draconian and unnecessary.
She said graffiti vandals were being treated more harshly than dangerous drivers.
Declaring that "beauty is in the eye of the beholder", Ms Pennicuik said corporate logos were as much a blight on the landscape as graffiti.
People who sprayed graffiti should be called graffiti markers, rather than vandals.
Australia prides itself on not having regulated borders and border guards. Why would we, when technology denies jobs and has no conscience?

It would seem on the surface this has all been rushed into operation in an attempt to monitor vehicular traffic to control the effects of equine influenza.

On Monday 24th September 2007, members of Parks Victoria will set about removing 150 brumbies from the Barmah Forest which covers an area of 75,000 acres which is 1 Brumby to 500 acres. It is claimed this small number of horses are causing severe damage over this huge area.
