"A person commits an offence, called treason, if the person:

(a) causes the death of the Sovereign, the heir apparent of the Sovereign, the consort of the Sovereign, the Governor-General or the Prime Minister; or

(b) causes harm to the Sovereign, the Governor-General or the Prime Minister resulting in the death of the Sovereign, the Governor-General or the Prime Minister; or

(c) causes harm to the Sovereign, the Governor-General or the Prime Minister, or imprisons or restrains the Sovereign, the Governor-General or the Prime Minister; or

(d) levies war, or does any act preparatory to levying war, against the Commonwealth; or

(e) engages in conduct that assists by any means whatever, with intent to assist, an enemy:

(i) at war with the Commonwealth, whether or not the existence of a state of war has been declared; and

(ii) specified by Proclamation made for the purpose of this paragraph to be an enemy at war with the Commonwealth; or

(f) engages in conduct that assists by any means whatever, with intent to assist:

(i) another country; or

(ii) an organisation;
that is engaged in armed hostilities against the Australian Defence Force; or

(g) instigates a person who is not an Australian citizen to make an armed invasion of the Commonwealth or a Territory of the Commonwealth; or

(h) forms an intention to do any act referred to in a preceding paragraph and manifests that intention by an overt act."[2]

The Commonwealth Government failed it its attempt on Friday 22nd June 2007 to abort the proceedings by seeking security for costs and strike out the claim.

The Honourable Justice Gyles rejected the possibility of security for costs, and ordered a Statement of Claim to be filed in the matter, and listed it again for the 19th July 2007.

At that time the Court may consider a motion to strike out, but not before then.

Professor Erryl Higgins:

In addition to the above 3 Court proceedings the CPPA's focus on Secure property Rights and the Native Vegetation Acts across Australia continues with an in depth 6 day workshop.

Commencing tomorrow, Friday June 22 the workshop is to research and prepare the final appeal on the Brereton J case - referred to as the "JUST TERMS" case, in the New South Wales Court of Appeal. - PJS V Australian Capital Territory Attorney General, New South Wales Attorney General and the Attorney General of The Commonwealth of Australia.

This team effort is lead by another Constitutional expert - Professor Erryl Higgins.

This Constitutional Scholar, recognised for his preparedness to defend issues in the public interest, with a strong recommendation and support from Victorian members of CAAP, the Professor, having already read the Judgement handed down by Brereton J, in regards to the matter bought before him by Peter Spencer, responded positively to an approach from the committee of CPPA, who travelled to Melbourne for meetings with him.

Following the Melbourne meeting, the professors real passion, for the Australian Constitution, its correct interpretation and the rule of law was kindled and following a comprehensive review over the next 2 weeks, of the files pertaining to the proceedings, Professor Erryl Higgins agreed to take up the lead role, in the fight on behalf of farmers and land owners.

Subsequently, Professor Erryl Higgins has offered CAAP his services in this matter, if necessary, all the way to the High Court. For this we are immensely great full to him and our in particular to our Victorian supporters who made all this possible, being entirely responsible for this initiative and ongoing support.

Metaphorically speaking, the "Chop a Tree Day" delivers a sharp response directly to Governments who usurp their Constitutional limited authority.

Over recent times, the politically expedient have treacherously Tampa-d with the inherent and Constitutionally settled principles surrounding Crown LANDRIGHTS and have tossed overboard, the most basic and fundamental historical freehold land use known to civilised law.

In metaphorically "Chopping a Tree" what the CPPA is drawing attention to is, that clearly, the all powerful, tyrannical Governments have abused and misrepresented the Freehold System and appear equally determined to deny the common people the due process of providing them their day in COURT.

If the apparent influence of contemporary governing tyranny is such, that the common people cannot be heard in the civilised area of the Court, then metaphorically speaking, we must reclaim our land rights from the fascist dictators and "chop" out all repugnant legislation, which now overrides the lawful Grown-registered approval constitutionally intended to remain with whoever holds the deeds.

Unless freehold law is reclaimed the civilised society as we know it will disappear.

Land rights belong to the people with the Private investment. Freehold is the greatest generator of wealth known to man. We need more freehold land then 14% - not less.
